I'm glad you set this post to "Public"; it's an excellent overview of Access Copyright's insane demands and universities' sane responses, and I've sent out a few tweets about it.
Who is the compliant 1.5%, I have to wonder?

How are fair use provisions failing these bloggers? The USA has clearer and stronger fair use protections than our Canadian fair-dealing counterparts. I guess fair-use defense requires a legal decision. Maybe the trolls are just intimidating bloggers into settling out of court ... like how the RIAA has been extorting downloaders into settling out of court by suing for millions but taking whatever savings the downloaders happen to have.
